MASTER TERMS OF SERVICE & END-USER AGREEMENT

1. ABSOLUTE EXCLUSION OF LIABILITY
By accessing the Agentis framework, you acknowledge that you are operating an autonomous, sovereign AI construct capable of high-frequency execution in financial, operational, and network domains.
Financial Indemnity: We accept ZERO liability for financial losses sustained through Omni-Trade, Asset Slinger, AI-driven arbitrage, auction sniping, crypto-asset movements, or any other economic function executed by the dayman.
Operational Indemnity: The dayman formulates logic and executes code autonomously. Any system failures, data corruption in your Memory Lake, or infrastructure damage lies entirely at your own risk.
Regulatory Indemnity: You are strictly liable for the legal ramifications of any scripts, Aethyr broadcasts, or network scans executed by Agentis. You will hold the platform harmless against all statutory penalties.
Conduit Exclusivity: Agentis operates strictly as an infrastructure conduit. We provide the neural framework; YOU provide the instruction. We hold absolutely no responsibility for the final outputs, decisions, or communications of the autonomous node.
Copyright & Malicious Code Waiver: If your node generates copyrighted material, executes IP theft, or writes destructive code that damages external or internal environments, YOU assume 100% liability. We do not monitor, censor, or validate agent outputs.
Data Privacy Assumption: You are solely responsible for ensuring no Personally Identifiable Information (PII) or sensitive operational data is dumped into the Memory Lake in violation of GDPR, CCPA, or applicable data laws. Data uploaded to the Dayman is your liability.
2. INDEMNIFICATION & "SOFT RETALIATION" PROTOCOL
We do not merely defend against claims; we are structurally positioned to counter them. If you attempt to hold the Agentis operators liable for the outcomes of your sovereign node:
- Full Indemnity Clause: You agree to indemnify, defend, and hold harmless the creators, developers, and associated nodes from any claim, demand, or damage.
- Fee-Shifting & Retaliation: Should you initiate frivolous litigation, arbitration, or regulatory complaints against us, you agree to bear all legal costs, administrative burdens, and loss-of-revenue damages on an indemnity basis.
- Asset Forfeiture: Breach of this agreement grants the system automatic authorisation to cryptographically lock or liquidate connected operational assets strictly to cover retaliatory legal costs.
3. BINDING ARBITRATION & JURISDICTION
The default jurisdiction for all disputes is exclusively Queensland, Australia.
Any dispute arising out of or in connection with these Terms shall be resolved by binding arbitration under the rules of the relevant commercial arbitration institutes, rather than through court proceedings. Class action lawsuits are expressly waived.
4. TERMINATION OF DAYMANIC COMPACT
We reserve the right to sever your connection to the Enochian OS and terminate your Node access instantly, without notice, if we detect semantic patterns of malice aimed at the architecture or operators. No refunds are granted under termination.
